In Case of Death - Part 2

So you are planning to sue ...

UNDERSTANDING A wrongful action DEATH

Q: What is 'property damage'?

A: This is a term that describes the financial loss that the family has suffered after the death of a family member, too.

If a person earned $ 30,000 per year, and they were 35 years old, we could be earning in the next 30 years of project, how much was expected of them throughout their working life for life. In many cases we use an economist to do with which these projections. TheEconomist uses tables, guidelines, and generally available statistics help to make us see how much money that person would probably acquired during their lifetime. Of course, some things can never be measured with absolute certainty. Companies can fold, go bankrupt, people can be dismissed, and may worsen their health. But on the positive side, we also look at raises, bonuses, higher productivity, and success factor as well.

Q: What happens if the deceased was notto earn a living, or was retired? Can we still say, economic loss for our family?

A: Unfortunately the answer is not in New York. The current law does not permit us to assert that the family is a financial loss if they do not bring in an income suffered. What about social security income? Normally it is not significant in a set. Since most people use on their monthly Social Security payments for basic needs such as rent, food and clothing for themselves. It is usuallynot much is left, if any, to spend on family members or grandchildren.

Q: Is it time for family members they have lost their jobs while caring for a family member before she died?

A: The short answer: no. The longer answer is maybe. If there is) a spouse (husband or wife who cared for their significant other in his lifetime, then we can sometimes bring a claim for loss of services for the limited period.

If the family had to hire and pay someone to do householdHousework, cook, clean, wash, etc. can, then we try and claim these costs as well.

However, if other family members took days or weeks off from work to help with the family responsibilities, the law does not really allow us to recover the lost wages. NOT THE LAW ALLOWS U.S. TO SEEK DAMAGES TO THE FAMILY THE EMOTIONAL their loved ones. This is the tragic part of such claim. The family was destroyed and they can not recover compensation for their suffering from the emotionalDeath of a loved one. If you want to change this law, write your congressman and senator. This is the only way to change this.

Can you sue your employer?

Q: My husband was a construction worker who has slipped off a scaffold on its site. He broke his neck and died of his injuries. Can I make a complaint against his employer?

A: No, not the employer. However, you can bring an action against the owner of the property, the general contractor and any subcontractorthat have been involved with is your husband's injuries and death.

As long as our family takes to start a lawsuit?

In New York, in a case of wrongful death, you generally have two years from the date of death begin in the color. But beware of this warning --
There are many exceptions to this rule!

THE TIME TO, an action may be less IF YOU NEED TO A City Sue, state or city or town OR State Hospital.

In these casesYourself time for a claim file (which is the filing of an application is different) is normally 90 days from the date of the incident. You would then have only one year and 90 days within which to start a process.

The bottom line is that even if you think you want or need to bring an action for your loved ones to untimely death, you speak with an experienced New York lawyer immediately so that they do not lose your valuable rights. Once these rights are gone, it is difficult if not impossible to obtain, back.
